Acceptance of Terms

Welcome to Poker Skill, an educational platform designed to help you learn and improve your poker skills through quizzes, lessons, and simulated gameplay scenarios. Poker Skill is operated by Funco, Inc., a Delaware corporation, with its principal mailing address at 504 W 7th St, Suite 200, Austin, TX 78701, USA. By accessing or using Poker Skill (the “Service”), you agree to be bound by these Terms of Service (“Terms”) as well as our Privacy Policy. If you do not agree with these Terms, you must not use the Service. Funco, Inc. (“we,” “our,” or “us”) reserves the right to update or modify these Terms at any time, and continued use of the Service constitutes acceptance of any changes.

Eligibility and Account

Minimum Age: You must be at least 13 years old (or the minimum age of digital consent in your country) to use PokerSkill. If you are under the age of 18, you should use the Service only with the involvement and consent of a parent or guardian. Poker Skill is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13 in compliance with applicable laws.

Account Registration: Some features may require creating an account. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the security of your account login credentials.

Unauthorized Use: Do not share your account or let others access it. You are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account, notify us immediately. We reserve the right to suspend or terminate accounts that violate these Terms or for security reasons.

Educational Service - No Gambling or Real-Money Gaming

Poker Skill is a skill-building and educational service, not a gambling platform. We want to be very clear on this point to comply with app-store policies and ensure a safe, broad-audience experience. There is no real betting, wagering, or monetary rewards in our app. The Service is intended to simulate poker strategy in a learning environment without any form of real-money gambling. In particular:

By using Poker Skill, you acknowledge that this app is solely for educational and entertainment purposes related to the game of poker, not for gambling. Our platform explicitly does not enable real gambling in any form. This clear separation is in line with Apple App Store and Google Play guidelines and is meant to ensure the app is accessible to a wide audience without a 17+ restriction for gambling content.

Permitted Use and Conduct

You agree to use Poker Skill in a lawful, responsible manner. Because our Service is educational and does not involve money, certain gambling-related behaviors are strictly prohibited on our platform, including but not limited to:

Poker Skill and its community should be treated with respect. You must not post or transmit any content within the app (if community features exist) that is offensive, obscene, or violates any third-party rights. We reserve the right to moderate or remove any user-generated content (such as chat, if introduced) that violates these standards or the spirit of our educational environment.

Subscription and Payments

Free Basic Access: Currently, Poker Skill offers its core learning features for free with no upfront purchase. We do not utilize any in-app purchases for virtual chips or gameplay advantages, nor do we have any loot boxes or gambling-like monetization. The app’s revenue model is focused on education - not gambling.

Optional Subscription: In the future, we may introduce an optional subscription plan or one-time purchases to access additional lessons, advanced content, or premium features (for example, more advanced courses or AI coaching tools). Any such subscriptions will be for educational content only and will not introduce any form of gambling or betting. If subscriptions or paid plans are offered:

No Real-Money Transactions: Aside from legitimate subscription fees for educational content, there are no real-money transactions in the app. You cannot deposit or withdraw money. Poker Skill does not handle any real-money pots, payouts, or gambling-related financial transactions.

Cancellation and Refunds: If and when a subscription model is in place, users will be able to cancel at any time according to the platform’s standard subscription management (for example, through your Apple ID or Google Play account settings). We will honor all obligations for refunds or trial periods as required by app store policies and applicable consumer-protection laws. Details on cancellation rights and refund policies will be provided when we introduce paid plans, and we will comply with all Apple and Google subscription best practices (including easy cancellation and clear communication of terms).

Intellectual Property

All content and materials provided through Poker Skill - including but not limited to text, questions, explanations, graphics, logos, software code, and design - are the intellectual property of Funco, Inc. (or our licensors) and are protected by copyright, trademark, and other applicable laws. You are granted a limited, non-exclusive, non-transferable license to use the Service and its content for your personal, non-commercial educational use only.

Restrictions: You may not copy, distribute, publicly display, reverse engineer, or create derivative works from our content without explicit written permission from Funco, Inc. This means you shouldn’t scrape our quiz questions or use our training content to build a competing product. You also may not use the Poker Skill name, branding, or logos in any way that could cause confusion or imply endorsement without our permission.

Privacy

Your use of Poker Skill is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. We are committed to user privacy and complying with all relevant data-protection regulations. By using the Service, you consent to the collection and use of information as outlined in the Privacy Policy. For example, we may collect data on your quiz performance to provide feedback and track progress. We do not collect any financial information for gambling because there are no gambling transactions in Poker Skill. Please review the Privacy Policy for details on data practices (a link will be provided in the app and on our website).

Disclaimer of Warranties

Poker Skill is provided as an educational tool on an “as is” and “as available” basis. While we strive to provide high-quality content and an uninterrupted service, we make no warranties or guarantees of any kind about the Service. In particular:

We expressly disclaim any warranties of merchantability, fitness for a particular purpose, and non-infringement. The Service is offered for educational and entertainment purposes only, without any warranty that learning poker via our app will meet your expectations or particular goals.

Limitation of Liability

Under no circumstances will Funco, Inc. or its affiliates, officers, employees, or partners be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or relating to your use of the Service. Because we do not involve real money or property, you will never lose money within our app. However, we also are not liable for any real-world losses or impacts that might occur outside the app. For example:

Funco, Inc. will not be responsible for any money you might lose if you choose to gamble in real poker games or tournaments after using our training. Any decision to play poker for real money is entirely independent of our Service and at your own risk. We do not encourage or endorse gambling for money, and we assume no liability for real-life outcomes.

We are not liable for any personal disputes or disagreements that arise between users outside the app (for instance, if you discuss poker with someone you met on the app and then have a conflict in a home game, that’s outside our responsibility).

If digital goods or subscription features are offered, our liability for those, if any, will be limited to the fees you paid us for that service in the applicable period. Since there are no cash transactions for gambling, the potential damages are limited to your subscription cost or similar.

In jurisdictions that do not allow the exclusion or limitation of certain liabilities, our liability will be limited to the fullest extent permitted by law. We do not seek to exclude liability for gross negligence, fraud, or intentional misconduct to the extent not permitted by law. However, you agree that our total liability to you, for any and all claims arising out of your use of the Service, will not exceed the amount (if any) you have paid to Funco, Inc. for access to the Service in the last 12 months, and $0 if no payments have been made (since the app is currently free).

Responsible Use and No Gambling Endorsement

Poker Skill is committed to promoting responsible play and learning. We reiterate: Our platform does not offer gambling. We encourage users to view poker as a game of skill and strategy. If you choose to apply what you learn on Poker Skill to real poker games, do so responsibly and legally. Poker can be an enjoyable hobby, but remember that gambling can be risky and even addictive - always be mindful of your limits.

By using our Service, you agree that Funco, Inc. is not liable for any gambling-related issues or losses you might experience outside the app. If you feel that you or someone you know has a gambling problem, we urge you to seek help (for instance, resources like BeGambleAware or other responsible-gaming organizations). Our app is here to teach and entertain, not to encourage real-money gambling.

Termination of Service

We hope you enjoy Poker Skill for a long time, but we may terminate or suspend your access to the Service at our discretion if you violate these Terms or if we deem it necessary for security, legal compliance, or other legitimate reasons. We may also terminate the Service or any part of it (for example, if we decide to discontinue the app) with reasonable notice to users when possible.

If your account is terminated due to a breach of Terms (for example, attempting to use the app for illicit gambling activities or other misconduct), you may lose access to any data or progress within the app, and you may not be entitled to any refunds for any paid features you had (subject to applicable laws and platform refund policies).

You are free to stop using Poker Skill at any time. You may also delete your account if such functionality is provided. Our Privacy Policy outlines what happens to user data upon account deletion.

Changes to the Terms

Funco, Inc. may update these Terms of Service from time to time as our features change or as required by law or platform policies. We will make efforts to notify users of significant changes - for example, by posting a notice within the app or sending an email if we have your contact info, and updating the “Last Updated” date at the top of the Terms.

It is your responsibility to review the Terms periodically. By continuing to use the Service after changes to the Terms are posted, you accept and agree to the revised Terms. If you do not agree with any update, you should discontinue use of the app.

Governing Law and Disputes

These Terms of Service, and any dispute that arises from your use of Poker Skill, will be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, and applicable federal law of the United States.

By using the Service, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes. We may also agree to alternative dispute-resolution mechanisms such as arbitration or mediation; if so, those details will be provided separately or as an addendum to these Terms.

International Use: Poker Skill is intended to comply with the app-distribution laws and regulations of major markets (e.g., U.S., EU, etc.). However, we make no representation that the Service is appropriate or available in all locations. Users who access the Service from jurisdictions where its content is illegal or restricted do so at their own risk and are responsible for compliance with local laws.
